A Representation Agreement is a legal instrument that appoints a person called your representative, to make legal, financial, personal and health care decisions for you.

These agreements are usually drafted to protect your interests and assets should you become unable to do so. This includes consideration for guiding the handling of your health care needs. You may appoint a specific representative for one or more different purposes.

Your representation agreement is governed by the Representation Agreement Act.

 

A Representation Agreement is used for health care and personal care matters (compared to a Power of Attorney which is used for financial and real estate matters).

 

 

There are two types of Representation Agreements, Standard and Enhanced.

Standard Representation Agreements cover routine financial and/or health care decisions. [Section 7 limited agreement.]

Enhanced Representation Agreements give broader powers to the representative, including the ability to deal with complex matters related to real property, major personal care concerns, major health care matters, and financial decisions. [Section 9 general agreement.]

Currently, the law in BC requires an additional consultation by a member of the Law Society of BC for an Enhanced Representation (Section 9) Agreement and we have partner firms to handle this.
